Audio Evidence Displayed In Court For Allegedly Operating Private Security Service Without License

The witness Inspector Mohamed Jusu in continuation of his examination in chief said the audio was save in a flash drive was displayed in Court

Defense lawyer Joseph Fizgerald Kamara objected to the tendering of the audio evidence noting that few audio has been extracted from the others.

He said the evidence is clear and that he wants to know which of the audio belong to the accused persons and wants to establish which audio belong to the accused persons and also connect the phones to the audio.

In addition, he said the evidence presented is uncertain and ambiguous and the prosecution cannot establish the evidence to the accused persons.

The prosecutor in reply said the defense should have waited for them to tender the flash drive before objecting.

The witness said the audios that were played were extracted from I-tel A 56 mobile phones retrieved from first accused.

Adding that the first set of the audio were sent by the first accused in a WhatsApp group called expandable SL and the second set were audios sent to the first accused by an orange number save as SO Lt, whiles all the other audios where from the I-tel mobile phone which is the primary source.

The said flash drive containing the audio messages were produced and tendered in court respectively as evidence against the accused persons.

I also printed screenshot material retrieved from the said A 54 Airtel mobile phones.

It was produced and tendered in court.

The witness recalled 17 July when he received correspondence and two mobile phones, one Iphone 13 pro max and one Samsung Galaxy A 32 from DSP Alusine Dumbuya operation officer CID, adding that upon receipt of the said mobile phones he used a command *#.

At the conclusion of his examination, he reduced his finding into a report signed and dated by him witness by Dst Sahr Foday Lebbie.

He said he printed photos retrieved from the said phones to form part of the evidence.

Defense objected to the tendering of the photos retrieved from the iPhone, noting that they have to associate the photos to the phone.

During cross examination by lawyer Joseph Fizgerald Kamara of the witness all the audios were retrieved from the I-tel phone of the first accused and extracted from a group called expandable.

The witness also confirmed that the forum has over 150 participant and that the names fall under APC logo.

When he was asked as to whether what the first accused said in the audio, he was speaking in the feature tense, the said not all but some.

The witness said the first audio message was based on the arrest of RTd captain Marrah`s vehicle and that it came from the first accused phone.

Lawyer Kamara suggested to the witness that he is not a voice expert, he replied in the affirmative.

He said the audio messages were based on the security of the APC party.

Lawyer Kamara put it to the witness that the audio two has nothing to do with the first accused, the witness said it was the first accused.

He put it to the witness that the police charged the accused persons because they are APC and not SLPP.

At this juncture, cross examination was deferred.

Lawyer Kamara renewed his application for bail on behalf of the accused persons noting that this is not the way to treat ex-service men.

Meanwhile, Magistrate Ngegba refused bail and adjourned the matter to the 28th September 2023 for further hearing.
