The matter between the state and Hon. Saidu Emmanuel Conteh and three others did not commence yesterday as expected.
When the matter was mentioned, State Counsel Yusif Isaac Sesay said they have two witnesses, and that they will not go on as they are considering another line of action.
He said in that circumstance they respectfully applied for a date in order for them to institute their line of action.
Counsel for first accused J.M Jengo opposed the application made by state counsel Sesay. He said the state knew the investigation is ongoing and yet still charged the matter to court. He therefore applied for bail on behalf of his client who according to him was unwell.
He said it will be good for the accused to be granted bail since the state council is unready in order for him to go for proper medical treatment.
Counsel for the second accused, Lansana Dumbuya said he was disappointed and dejected when he heard the state asking for an adjournment.
He said the offenses his client is standing trial for are bail able offenses. He also informed the Bench that they have tried their level best to get the medical records from the hands of the medical doctor but to no avail.
He applied for the Bench to order for the said report to be made to the court.
Addressing the court on the issue of bail, defense counsel Lansana Dumbuya furthered that it is not the fault of his client for the state to delay their investigation. He said justice must be seen to be done in the matter.
Defense counsel Lansana Dumbuya in continuation said his client is an honorable Member of Parliament representing a whole constituency.
“My Lord I prayed that bail be granted to him, he has serious medical condition if not treated will speedily affect him”, he stated.
He craved the Bench`s indulgence to grant second accused bail, adding that the state internal arrangements should not be a barrier to their liberty.
Counsel for third and fourth accused person M.N Bittar adopted his previous application for bail.
He said third and fourth accused are working for a company who has no bearing to what was before the court.
State counsel Yusif I Sesay upheld and adopted the previous objections made by the substantive prosecutor.
He said the line of action they want to take is on the best interest of justice. He further stated that they acknowledged the application made by the defense but asked for a date they are expected to proceed.
Justifying their point, Mr. Sesay said the line of action will take time and Monday will be convenient.
The Bench urged the state to come with their witnesses on Monday 2nd of August 2021, and make progress.
He ordered all accused persons to be remanded.
