A middle age man Donald Hollist took his mother Dorothy Ngorgoh and two other family members, Denise Ngorgoh and Mr. Ngorgoh to court on a Criminal summon.
They are charged with Trespass, Threatening language, Common Assault and Malicious Damage contrary to section 51 of the Malicious Damage Act of 1861.
It was alleged on count one and two that on the 13th of May 2023, at Magnus Street Wellington, the accused persons trespass the premise of complainant Donald Hollist having stopped them not to do so and also assault him.
On count two and three, it was alleged that on the same date and place the accused persons used threatening language against complainant and Malicious properties worth twelve thousand new Leones belonging to Complainant.
When questioned about the relationship between complainant and the first accused, complainant said the first accused is his mother.
Complainant said he is the administrator of the said property they are in court for.
Magistrate Sahr Kekura said being an administrator does not mean he is a beneficiary.
Shortly after the matter was mentioned by the court clerk for further hearings, Donald Hollist in continuation of his testimony, has identified photos of the fortune at will give to him by his late father and a document to ascertain same.
Testing his testimony by defense counsel Grant, Donald Hollist in a question put to him agreed that the said property they are in court for is in Wellington which is a distance from where he resides at New York, in the Eastern part of Freetown.
He was about to be questioned about who gave him possession to that property when his lawyer Musa A Kamara rose from the bar and argued that, what the defense is trying to ask is not part of the matter.
Responding, magistrate Kekura said it was the prosecution who identify photos and documents relating to title so the question of the defense are in place.
Continue with his testimony, Hollist said the property was built by his late father who he said was not sure whether before his death was married to first accused his mother.
Questioned about the age of first accused his mother, complainant Donald Hollist said she is eight years old. He also confirmed that his mother and the two other defendants deed assaulted him on the date of the incident and engaged on destroying the said items he presented to the court.
Confronting him about the date of the incident, he said he did saw second and third accused persons and never fabricated the offenses levied against them.
Denied instituted the matter to have sole ownership of the said property at No.21 Magnus Street.
At the end of cross examination the matter was adjourned to 17th of August 2023 for prosecuting counsel to put up his next witness.
