Mustapha Kabba made another appearance at the high court of Sierra Leone on the 30th November 2021 before Justice Komba Kamanda in Freetown on four count charges of Robbery with Aggravation contrary to section 23 (1) (a) of the larceny Act 1916 as Repealed and Replaced by section 2 of the imperial statues (Criminal Law) adoption (Amendment) Act 1971 Act No.16 of 1971.
According to the particulars of offence Mustapha Kabba on the 1st September 2020 at Freetown in the Western Area of the republic of Sierra Leone being armed with a black power line Semi- Automatic gun with serial number AR72757 robbed Mrs. Kitty Fadlu Deen one dark grey 2018 Toyota Rav-4 Jeep with registration number AOG834 valued at twenty four thousand five hundred united states dollars equivalent of Two Hundred and Forty Five Million Leones property of the said Mrs. Kitty Fadlu Deen.
Mustapha Kabba was indicted on four count charges of robbery with Aggravation on count 1 and on count 2 robbery with aggravation contrary to section 23 (1) (a) of the larceny Act 1916 as repealed and replaced by Section 2 of the Imperial Statues Adoption Act 1971, Act No. 16 of 1971.
According to the particulars of offence on count 2 the accused Mustapha Kabba on the 1st September 2020 at Freetown in the western area of the republic of Sierra Leone being armed with a black power line semi- automatic gun and robbed Mrs. Kitty Fadlu Deen one Samsung J-20 mobile phone valued at one hundred and fifty united states dollars ($150) equivalent to one million five hundred thousand Leones property of the said Mrs. Kitty.
The charges furthered on count 3 that the accused Mustapha Kabba on the 1st September 2020 at Freetown in the western area of the republic of Sierra Leone caused grievous bodily harm with intent contrary to section 15 of the offences act against the person Act 1861, that the accused caused grievous bodily harm to Mrs. Kitty Fadlu Deen with intent to do her grievous bodily harm.
On count 4 attempting to strangle contrary to section 21 of the offences against the person act 1861 that Mustapha Kabba attempted to strangle Mrs. Kitty Fadlu Deen with intent to enable himself to rob Mrs. Kitty Fadlu Deen.
Prosecution witness (PW12) Brima Amara Munu a Detective attached to the Criminal Investigations Department center police station. He said he recognized the accused, he recalled that on Friday 18th September 2020 he was on duty at the homicide syndicate headquarters in Freetown when he received a transfer and enquiry case file from Lumley of robbery with aggravation.
Prosecution witness (PW12) said the accused was brought in together with the enquiry file from and with the exhibit of a dark grey Rav-4 vehicle 2018 model, a black power line semi-automatic gun, a yellow colored blood stained towel, 1 black strap, 1 toilet roll partly torn and a fake diplomatic number plate with registration number 19cd12.
The witness furthered that the accused in his confessional statement at the police said he often visited the drive of the complainant and that he has been at the compound once as a visitor to see the complainant under pretense as the security guard gave him access.
The accused said he went upstairs and stopped by the stairs without speaking to the complainant Mrs. Kitty Fadlu Deen and stole a mobile phone and sold it to a passerby on the highway at le200, 000.
The prosecution witness concluded that in the accused confessional statement when asked about the vehicle he said he recognized the vehicle and that he stole the vehicle and later changed the number plate of the vehicles original number plate to a diplomatic number and discarded it at the Lumley highway, in fear of been detected and traced.
He said he obtained the gun from the quay and used it to frighten the complainant even though it was not loaded.
The defense counsel for the accused was represented by H. Momoh whilst the state prosecutor was represented by Yada Williams Esq. The matter has been adjourned to the 7th December 2021.
