Peter Samura has made his first appearance before Justice Momoh Jah Stevens at the Sexual Modern Offences Court in Freetown on the 12th of November 2021, of sexual penetration contrary to section 19 of the sexual offences Act 2012, Act no12 of 2012, as repealed and replaced by section 4 (a) (ii) of the sexual Amendment Act 2019, Act no 8 of 2019.
First Prosecution Witness (PW1) testified before Justice Momoh Jah Stevens at the sexual Modern Offences Court. The victim said she was in Jss3 when the Accused approached her and professed love relationship to her.
The victim continued that she first refused the accused and told him she was afraid and the accused then asked to be a friend to the accused of which the victim said she agreed to.
The victim furthered that on a Sunday in May, ending the accused asked him to meet him at his father’s residence at tender hill and the victim said she did and upon arrival the victim said she met the accused elder brother seated with his wife and the accused accompanied her inside his room.
The victim said the accused laid her on the bed and raped her, the victim said she was crying and that the accused made a statement to her that it was only two of her cables that she cut off, the victim said the accused gave her water and swore on it that the victim shall by no means say anything to anyone if asked and the victim must never mentioned his name.
The victim said she refused the water but the accused forced her to drink the water, the victim said she returned home but said she was walking abnormal. The victim continued that she was explaining to her neighbor not been aware that her eldest sister was listening to the conversation and that her sister alarmed the issue to the parents.
The victim furthermore said her mother being a professional nurse, decided to examine her and confirmed she had been tampered with, the victim said her mother then collapsed and that out of fear she ran outside to her mother’s friend and she spent the night there.
The victim explained that she was then asked in the morning of who tampered with her but the victim said she refused and she went to the accused sister and she met the accused there and he told him and the accused threatened the victim not to say a word neither mention his name and asked her to leave not to raise any suspicion on the matter.
The victim added that she slept in an uncompleted building and went again to the accused sister in the morning and the accused sister said she wants to give the victim an injection but said that the victim’s mother is a nurse and is aware of the victims cycle, the victim said the accused sister gave her some money to go to her a pastor.
The victim concluded that she went to the pastor but met the pastor’s wife and the pastor’s wife called on her mother and after serious pressure confessed, that the accused sexually tampered with her, and the matter was then reported to the police.
Second Prosecution Witness (PW2) Hannah Scott the victim’s Mother who is living at 152 `upper Jalloh terrace thunder hill, and a nurse said around May by 11-12 midnight she heard a knock on her door and it was the victims sisters who came to asked her about the victim and she been a nurse decided to examine her, the victim’s mother said to her shock she found out that the victim had been tampered with and she then collapsed.
The victim’s mother continued that she woke up to hear that her daughter had ran away and got a call from her friend who informed her that the victim was at her house. The victim’s mother said she told the friend to keep her till morning as her and her friend baby k asked the victim again and she refused.
The victim’s mother also said that she went for work and on arrival at home found out that the victim was not at home and got a call from the pastors wife who informed her the victim was with her and went there again and forced her to speak unknowing to the victim’s mother that the victim was scared to confessed because of the water the accused gave her to drink.
In conclusion the mother of the victim said the victim confessed that the accused Peter Samura sexually penetrated her and she confirmed from the medical report given to her at the rainbo center had reported the matter to the police.
According to the particulars of offence Peter Samura on a date unknown between the 1st February 2021 and the 31st May 2021 at Freetown in the western Area of the republic of Sierra Leone engaged in an act of sexual penetration with an underage girl.
The accused person was represented by C Taylor Young while the state was represented by Pious Jnr the matter has been adjourned to the 29th November 2021, and the accused is still in remand.
