Foday Sesay made his first appearance before Justice Monfred Sesay of the High Court No.1 in Freetown Sierra Leone on one count charge of Murder.
Foday Sesay was arraigned before Justice Monfred Sesay and a 12 man Juror.
First Prosecution Witness (PW1) Ibrahim Sorie Sesay of Peninsula road and a Businessman said he recognized the accused person in relation to the said matter and that the deceased was his younger brother Alimamy Sesay.
He said on the 26th March 2017 at around 12 midnight he received a call from Alhaji Uror Bangura who informed him that his brother was lying helpless because he had a confrontation with someone and was lying motionless unable to speak or move.
Ibrahim Sorie Sesay said he immediately left for the place and met his brother laying on the ground with his stomach and called out to him three times but he had no response from his younger brother. He said he rushed him to the police at Adonkia Police station and showed them his brother and the police together with him came at the scene of crime and questioned and arrested some people and took the body of his younger that had passed away and discovered a big wound by his left side and blood oozing from him.
He continued that the crime officer advised him to go with the body at the Connaught hospital for postmortem examination to be carried out on the deceased.
He concluded that postmortem results test result was out whilst the police investigated the matter and arrested the accused person on the same day.
In a cross examination by defense counsel K Kanu he asked the prosecution witness Ibrahim Sorie Sesay about how he was informed of what transpired between the deceased and the accused person he said according to the caretaker of the place by the name of Orsanda the accused and the deceased had an argument.
He continued that the accused called his brother a drunkard and the deceased responded to the accused that he is a gambler and that the accused alter a statement to the deceased saying that he will be the last person to end the life of the deceased.
He said according to the caretaker Orsanda who explained to him that whilst on the argument the accused person had a knife in his pocket and rushed to the deceased and fought with the deceased and took out the knife and stabbed the deceased and within the process the deceased dropped to the ground.
He concluded according to the caretaker the deceased and the accused was drinking alcohol together happily when the fight between them happened.
Second Prosecution Witness (PW2) Alhaji Benda Swaray a detective police constable 10222 attached at the criminal investigations department CID at the Kenema Police Station said he was first attached at the Adonkia Police Station and the deceased brother Ibrahim Sorie Sesay of Peninsula Goderich reported a case of murder.
He continued that Ibrahim reported a case of Murder of the accused person and that the matter was allocated to him for investigation and he and the Senior Crime Officer (SOCO) D Sergeant 11407 JC left the station for No. 2 River Village at the scene of crime where the deceased was identified by the brother lying on the ground with a wound on the chest and a stick by his side.
Alhaji Benda Sesay said photographs were taken by the SOCO and the body was taken to the mortuary and they returned to the station and that statements were taken from the complainant and witnesses on the same date and later received a phone call from the head man Mr. Abubakar Turad Conteh that they have the accused person with them.
He said a team of officers went to the place and arrested the accused person and the accused person was identified by the headman and was brought to the station.
The defense was represented by K Kanu whilst the state was represented by A Jalloh. The matter has been adjourned for further hearing.
