Police Witness who is a pupil has testified before Justice Komba Kamanda in the Modern Sexual Penetration Court in Freetown has on the 22nd June, 2021. It would recall that between the 1st April to the 30th April 2020, at Jui in the Western Rural of Freetown the accused person allegedly sexually penetrated the victim at Kamayama Lumley Freetown.
Witness said she knew the accused person at Jui as a trader, and recalled the 1st April to the 30th April 2020. Witness said she went on holiday to her aunty (Ketty) in Jui. She said her aunty normally left her in the shop to take care of the shop. Witness said one day when her aunty was not around the accused person pass with palm win rubber and called her to meet her inside her aunty house, which she complied. She said she was inside her aunty house watching film and the accused person went in and told her that whatever thing she wants he will give her and whatever they will do nobody should know. She said he took the bedspread that she usually spread to sleep and spread it on the floor. She said he removed his trousers’ and removed my skirt and sexually penetrated me.
She said she felt pain and cried, while the accused took the pillow and put it in her mouth. Later the witness said she saw blood oozing out of her body. She said the accused person gave her 5,000 Leone and promised to give her brown new crap.
Witness said she took bucket of water to clean up and used tissue. Later the witness said she received the footwear from the accused person as promised and wore it to visit her mum. She said her mum enquired about the footwear. According to her, she lied to her mum that she had been saving her lunch to get herself footwear. She said on the 8th June, 2020 the accused person came back when her aunty was not around and they have sex; this this time there was no sign of blood.
Under cross examination, the accused person asked the victim whether she normally leave someone at place of business. Witness said you left a woman in your shop and you went to meet me. The accused person says he has never entered the place. Witness said he has entered the place on two occasions.
When the mother was testifying Police Constable 17518 Conteh K attached to the Waterloo Police Station, said she knew the victim and the accused person. She said she can recall between the 1st April to the 30th April 2020. She said she was at her working station when she saw her daughter who paid her visit to her for an hour. The witness said her daughter was not walking properly. She (Mother) said she decided to pay visit to her aunty at Jui to know what went wrong. She continued that upon holding the phone from her daughter hand the accused person called her that night asking if she had gone asleep. She said she called her aunty to ask for the password so that she can get access to the phone.
She said on the 8th June, 2020 she saw blood oozing out from her daughter private part. She said they went immediately to aunty Ketty’s house. She said they entered the accused person shop they pretend as if they were buying from them; they acted in this form not to draw attention of people. She said after that they went to the Kissy Police Station with the accused person. She said the police later issued police medical request form for medical examination at the rainbow Centre.
Under cross examination, the accused person putted it to the witness that she was the individual who force him to answer the allegation. Witness said not to her knowledge. The matter is prosecuted by State Counsel Y.I. Sesay, while there was no lawyer representing the accused person. The matter has been adjourned to the 6th July, 2021. heiW�A+5�
