Complainant Testifies in Wounding Matter

Police Witness One (PW1) Soko Junior Kai Samba has testified before Magistrate Sahr Keikura of Court No.1 on the 6th May, 2021 at the Pademba Road Court in Freetown. Alie Conteh and Isha Conteh were arraigned in court before Magistrate Sahr Keikura on three counts indictment of wounding, assault and abusive language all contrary to the Laws of Sierra Leone.

According to the case file, the accused persons on 11th December, 2020, at 35D Jarrett Drive off Regent Road Grass Field Lumley wounded the complainant (Soko Junior Kai Samba). In counts two the accused persons assaulted the complainant and count three the accused persons used abusive language against the complainant.

The witness said he recognized both accused persons. He continued to say on the 11th December, 2020 he was at 35D Jarrett Drive off Regent Road Grass Field Lumley was when one Rachael Komba Conteh visited him and they both had drinks; while the first and second accused persons were at the said drive.

PW1 continued that during that time the first accused person rained all sorts of abuses on him (bastard child) and confronted him with threaten remarks such as “I will kill you”. Later the second accused person joined the first accused person; they both pelted stones on his head and hit him with sticks.

Immediately, the witness said he went to the Lumley Police station to make statement and a Police Medical request Form was issued him to see the Police Doctor after which the medical form was endorsed and later returned it to the police station. The witness revealed that photographs were taken of him when he was in a pool of blood and the shots were developed into pictures forms.

Under cross examination, by defense counsel C.I Williams, the witness said he can recognized Brima Kargbo who was the first to hit him together with the First accused person, as that was what he told the police.

While he was been led by the prosecutor, the witness said he was hit with a stone by both accused persons. Defense counsel further asked PW1 that all what he told court and what he said to the police are two different things. The witness said yes.

Defense Lawyer C.I Williams applied for bail for both accused persons pursuant to section 79 sub-sections 2 and 3 of Criminal Procedure Act No. 32 of 1965 and the bail application was granted.  The prosecutor for the case is Inspector I.S.Mansaray while Lawyers C.I.Williams, I.S.Y. Kamara and C. Elloba represented the both accused persons. Matter has been adjourned to the 18th May, 2021.
