40 years old Alhaji Osman Kabia a business man, Abubakar Kabia a driver and Lamin Kabia a baker made another appearance before Magistrate Santigie Bangura of Pademba road court No.2 in Freetown on two count charges to wit Conspiracy to commit a crime contrary to law and malicious damage contrary to section 51 of the malicious damage Act 1861.
According to the particulars of offence the accused persons on Sunday 3rd September 2023 at yellow Mosque Manor Corner Waterloo the western area in Freetown conspired together and with other persons unknown to commit a crime to wit Malicious damage; on count two the accused persons at the same place and date maliciously damage corrivated Zinc fence value thirty thousand three hundred Leones (30,300) property of Kahota Sesay and Abubakarr Kanu Mansaray.
When the charges were read and explained to the accused persons, they pleaded not guilty.
Assistant Superintendent of police Abdul Sannoh led third Prosecution witness (PW3) Hassan Denis Kargbo said he recognized the complainant and the accused persons.
PW3 said he recall on the 3rd September 2023 on the above date the complainant went with his workers at his land and built up a fence around 9pm to 10pm, the second accused person went with thugs at the fence which was built by the complainant- the witness said the second accused person told the thugs to demolished the fence.
The witness continued that at the same time he saw someone with face mask holding a cutlass and making an attempt to get close to them, but they escaped. The witness said he went to Ross Road Police Station where statement was obtained from him.
The witness was cross examined by defense counsel A.O Gbla.
Meanwhile, Magistrate Bangura adjourned the matter to the 5th January 2023 for further hearing bail continue for the accused persons.
