Alpha Jagitay father to Ibrahim Jagitay now deceased has on Tuesday 26th September 2023 testified on the alleged murder of his son involving his nephew Mohamed Jagitay.
The accused Mohamed Jagitay made his second appearance before magistrate Mark Ngegba of Court No1 and was charge with one count of murder contrary to law.
According to the police, the accused on the Friday 28 July 2023, at Kellie Farm, Malambay village, Waterloo in the western rural murdered Ibrahim Jagitay.
Prosecution witness No 1 (PW1) Alpha Jagitay led in evidence by Inspector Sellu TAP said he is a baker, adding that he knows the accused person as his elder brother’s son and the Ibrahim Jagitay now deceased as his son.
The witness further recalled 28 July 2023, adding that on that day he was at home when he got information from Amadu Jagitay about the disappearance of his son. He added that he was told that it was the accused that took him out on the night he went missing.
The witness said upon that information he went to the resident of the accused and asked him about the where about of his son.
”When I confronted him, he confessed that he was the one that took the deceased out on the night he went missing, whiles I was talking to him I notice bruises all over his body and when I asked him as how he sustain those wounds, he said he got into an accident”, he narrated.
The witness said he immediately took the accused to the Calaba town police station and reported the matter, adding that the police they asked him to go and look for his missing son.
Two days later, the witness said he saw a video of the remains of his son on social media, and was told to go to the Connaught hospital for identification of the remains which he did.
He added that he identify the body as his son whom he said was brutally murdered.
According to the witness, at the Calaba Town police station the accused made a confessional statement that the wound he sustains was as a result of the fight between himself and the deceased.
He said on the 2nd August 2023, he witnessed the postmortem examination on the remains of the deceased and later the cause of death certificate was issued to him by the police for proper burial.
He said he made statement at the Calaba Town police station.
Lawyer M Rashid defense counsel for the accused requested for an adjournment to cross examined the witness.
Magistrate Ngegba remanded the accused in prison and the matter was adjourned to the 3rd October for cross examination of the witness.
Police Inspector Sellu TAP is prosecuting the matter in court.
