Magistrate Sahr Kekura of Ross Road Court No.1 has on Monday 25th September 2023 committed fraudulent conversion matter involving Kabba Sorie Suma.
Kabba Suma was before the court on a count of fraudulent conversion contrary to law.
Magistrate Kekura said the charge was read to the accused, but no plea was taken because it was preliminary investigation.
The brief fact of the matter , magistrate said the accused, on diverse dates between 1st March and 30th April 2016 at Samuel Kissy in Freetown, fraudulently converted seventeen thousand United States dollars ($17,000) forty-two thousand leones (NLe42,000) entrusted to him by the complainant, Borbor John Conteh for the purpose of buying building materials.
All prosecution’s witnesses were cross examined by defence counsel, G. Conteh esq and submitted no case submission.
In his no case submission, he said the defence counsel, G. Conteh stated that the there was no sufficient evidence the accused.
Contrary, prosecution’s PW1 and 2 in their examinations in chief told the court that the complainant gave the said amount to the accused for the purpose of buying materials.
Magistrate Kekura said based on the evidence adduced before him including the testimonies of PW1 and 2 and the accused’s confessional statement he made to the police, he arrived to the conclusion that there is sufficient evidence against the accused and the matter was committed to High Court for trial.
When the defense counsel was asked if had anything to say responding, he answered in the negative and assured the bench that he wished to give no further evidence at the High Court.
