Foday Daramy who was arrested on 30th August 2923 by Police Constable 17702 George S appeared before Magistrate Sahr Kekura of Ross Road Court No 1 in Freetown for allegedly breaking into the store of Bashir Mohamed Kamara’s store and stealing therein a compressor machine and generator parts worth nine thousand Leones (NLe9, 000).
The incident occurred on 24th 2023 in Wellington Freetown.
Daramay was arraigned before the court on a count charge of store breaking and larceny contrary to section 20 (1) of the Larceny Act of 1916.
It was alleged that the accused, Foday Daramy, on Thursday 24th August 2023 in Freetown, entered into the complainant’s store and stole a compressor machine and generator parts valued at NLe9,000.
Led in evidence by Chief Inspector Isatu Bangura, prosecution witness (PW) 1, Momoh Mansaray residing at Koya Town in Wellington Freetown, a Kekeh rider said he recognized the accused person as a mechanic and recall 23rd August 2023.
He said on that day he was at an ‘ataya base’ within the same community when he got information from one Foday about the accused.
PW1 said upon receiving the information, he and Foday went to the compound where the accused entered and saw the accused with generator parts and compressor machine with a hammer.
The witness said when he asked the accused where he got the following items, the accused told him that he saw them at the backyard of one Mr Mohamed’s compound who instructed him to take them along with him.
The witness told the court that the accused confessed to him that he stole the items from the factory.
Subsequently, he said the accused was arrested and taken to the Wellington Post and reported the matter.
He said he and a police officer visited the crime scene and discovered that the accused coruscated the main door leading to the factory, adding that the police officer took photographs of the scene and were taken to the police post as exhibits.
Photographs taken at the crime scene were produced and tendered to mark Z1-2.
Defence counsel A. B Kamara sought for an adjournment for him to cross examine the witness on behalf his client which was granted.
The accused was refused bail and remanded at the Male Correctional Centre on Pademba Road in Freetown.
The matter was adjourned to 19th September, 2023.
