28Years Old Remanded for alleged disorderly Behavior

Magistrate Sahr Kekura of Ross Road Court number one has refused the bail application made by defense counsel Alie S Sesay on behalf of his client John Sesay.

Twenty eight years old John Sesay was arraigned before the court for disorderly behavior (thuggery) contrary to law.

It was alleged that on the 15th of August 2023 at Dan Street Police post, the accused displayed in a disorderly manner in the presence of onlookers and the police.

Led in evidence by Assistant Superintendent of Police MB Conteh, Assistant Superintendent of Police Abdul Raza Kamara attached to Dan Street police post as the Officer in command recognized the accused in the dock.

He said on the 15th of August 2023, he was on duty at the above mentioned police post between ten to eleven o’clock in the morning he was addressing a matter when one Foday came in with a report that he was assaulted by alias cartel now the accused.

He said he stopped complainant who was in blood and asked what went wrong. He said whiles complainant was explaining he heard people shouting ‘ he is coming” and as soon as he lifted his head, he saw the accused advancing with two big stones.

The witness further narrated that few yards towards the post the accused throw the first stone which hit a suspect Amadu who is also a complainant in respect of this matter. He said the accused was about throwing the second stone when complainant Foday rushed and grabbed him and he in turn started fighting.

 “My lord me and my men struggled to separate him”, he said.

ASP said he questioned the accused about his conduct towards the station and he replied that it was first complainant Foday who started the fight. “I tried to convince him to calm down but he was desperate to revenge even when he is in our hands”, he stated.

The commanding officer said he tried to talk to him but he used the ‘f’ word saying he is not afraid of any police officer.

He said on that note, he rang the Local Unit Commander intimated him about the current situation at the post and he instructed him to call the Operational Officer to take the accused to Ross Road police station.

ASP Kamara said on their way going to the station, the accused Continue to fight them but they were able to put him under control and he was asked to make statement.

At the end of cross examination, defense counsel Alie S Sesay applied for bail for and on behalf of his client citing section 79 sub sections 2 of the Criminal Procedure Act No.32 of 1965. Among other things, defense counsel said the accused has reliable persons to stand as surety on behalf of his client. He said if granted bail he will not jump it neither interferes with the prosecution witnesses.

Having heard the application for bail, magistrate Sahr Kekura refused the accused bail and adjourned to the 30th of August 2023 for continuation.

The accused is also before the court in another case file for wounding complainant Momoh Amadu Jalloh.
