Magistrate Hadiru Daboh of Ross Road Court in Freetown has on the 7th April, 2021 discharged a 35 year old pregnant woman, Sammoh Fofanah on allegation of fraudulent Ttransaction.
The discharged came after Lawyer Madieu Sesay representing the accused made an application for his client to be discharged, stating that the accused has made several appearances without the presence of the complainant and that the Magistrate should consider the present condition of the accused person.
Lawyer Sesay made the application pursuant to section 94 Act No.32 of the Criminal Procedure Act of 1965. However, his application was granted, and the accused was discharged accordingly.
The accused Sammoh Fofanah was charged with the offence of converting monies meant for another purpose with intent to defraud contrary to section 32(I) of the larceny act 1916.
According to the charge sheet on the 22nd January 2021 at kola tree Calaba town with intent to defraud, unlawfully caused money to be paid by Mariama Sallieu Conteh (Complainant’s daughter), the sum of six hundred and fifty thousand Leones (Le 650,000.00) to do online course in Malaysia under Qnet known same to be false, giving by the Complainant, Kadiatu Kamara.
