Hon. Justice Manfred Sesay on Thursday 3rd August 2023, ordered Bench warrant for absent accused Aiah Komba and his surety Finda komba on the case of murder.
The accused Mohamed Johnson, Aiah Komba, Kalilu Fofanah, Victor Kellie and Ishmael Charles all charges of murder.
Lead state prosecutor, Aruna Jalloh stated that the surety Finda Komba and the accused Aiah Komba was absent in court due to reason unknown.
He informed the court that the state was to bring witness, but he was assigned to duties out of the country, to which he promised of his return upon the next adjourned date.
He outlined that the accused absent caused serious delayed on the trial, He said they have also reduced to 10 Jurros for a speedy trail, while the surety that is expected to bring in the accused, both of them are absent in court.
He therefore applied that the remaining accused bail condition should be vacated, because if they continued in bail they might not come to court and the case will be delayed, he told the court.
In his plead mitigation Lawyer for the accused persons R. Bangura told the court that his learned colleague is on his grounds and told the judge to temper Justice to the absentees.
He informed the bench that the accused persons on bail treat the matter with utmost seriousness and they have demonstrated of their individual respects on their bail condition in respect of the alleged murderer.
He said each of the accused carries their own cross and the submission made by his colleague on the other side that the remaining accused bail should be seized, because he thought that they might not come to court, saying that the judge should consider that the accused on bail respects the court and they will willing to appear in court anytime they call upon.
After listening to both counsel, Hon. Justice Monfred Sesay order bench warrant for the shorty and the absent accused and remanded the remaining accused persons.
Matter has been adjourned to Wednesday 9th August 2023 for further hearing.
