20yrs Old Fatmata Moseray a Petty trader made her first appearance before Magistrate Peter Brima Gogra of Pademba road court No.6 in Freetown on two count charges to wit Wounding Contrary to Section 20 of the offences against the person Act 1861 and assault occasioning actual bodily harm contrary to section 47 of the offences against the person Act 1861.
According to the particulars of the offence on Monday 5th December 2022 at Regent Road Lumley the western area of Freetown maliciously wounded and assaulted Isatu Kamara.
The charge was read and explained to the accused person and he pleaded not guilty.
Police Constable 14071 Mustapha Massaquoi led the first Prosecution witness (PW1) Isatu Kamara a trader and she recognized the accused person. The witness said they used to live in the same community and recalled the 5th of December 2022 something transpired between her and the accused person.
PW1 said she went to the accused person’s house to collect the micro-credit money but the accused quarreled with her. Later, the witness said she asked the accused person to follow her to their office to meet the manager, and immediately, things turned out to be different. At the office, the accused person slapped the witness and they fought; the accused took a stone and hit her in her eyes; the witness fell on the ground and sustained injuries to her eye.
PW1 said she saw blood oozing from her eye and went to the police station; made a report and was issued a police medical form and was treated; the police medical request form was produced for identification in court to form part of the court records.
The accused person was unrepresented
The main while, Magistrate Gogra refused bail and sent the accused person to the female correctional centre in Freetown and was matter adjourned to 17th January 2023 for further hearing.
