Prosecution witness (PW) 3 Sia Fanta Monseray on Friday 14 during his testimony before Magistrate Isata Sellu Tucker of the Pademba Road Court No.2 has revealed that the first and second accused, Abubakar Sesay alias Cartel, and Rashid Rogers alias Shylion assaulted, wounded and robbed Mr Moseray of his properties valued at twenty-seven thousand, seven hundred and fifty leone (Le20,750).
The accused, Sorie Turay, Abubakar Sesah alias Cartel, and Rashid Rogers alias Shylion appeared before the court on conspiracy, robbery with aggravation, assault occasioning actual bodily harm, wounding and larceny, contrary to the laws of Sierra Leone.
it was alleged that the police that accused, on Monday 18 September 2022 at Angola Town in Goderich Freetown, conspired with unknown persons to commit a felony to wit, robbery aggravation.
The charge sheet furthered that the accused, on the day in question assaulted and wounded Fayia Moseray in a manner thereby causing him grievous bodily harm.
It was alleged by the police that the accused, on the same date and place in Freetown robbed Fayia Moseray a Toshiba laptop valued at five thousand, two hundred leones Le5,2000, a stabilizer valued at four hundred and fifty leones (Le450), a power bank valued at three hundred leones (Le300), one Samsung galaxy Mobile valued at two thousand, five hundred leones (Le2,500,000) and another Samsung galaxy A mobile valued at seven thousand leones, two extensions valued at sixty hundred leones, a black back pad valued at three hundred leones, and cash of four thousand, nine hundred and forty Leone (Le4,940,000) totalling Le20,750.
Sia Monseray continued that she knew the complainant as her uncle and recognised the accused on the day in question. And she recalled Monday 18 September 2022.
The witness disclosed that at around 3:30am during fast month, she was asked by the complainant to boil water for him.
She being she was not having water inside, that promoted her to go to the kitchen in search of water, adding it was rather unfortunate that there was nor water into kitchen.
PW3 told the court that the complainant’s younger brother, T. Boy instructed her to collect water in his room, which she did.
‘My Lady, when I have fetched the water, on the way going to kitchen, I heard a noise behind me. When I turned my back, I saw the first and second accused and other men well armed to the teeth questioning T. Boy why he was outside at that time of the night. Upon saying that, the second accused rushed at me within his cutlass and commanded not move or either shout,’ the witness narrated to court.
She noted that the second forcibly pushed her again, adding that both the first and second accused including the other guys and rushed into the complainant’s room.
Sia informed the bench that she noticed that she was alone standing, she then rushed to one of his neighbour and explained to him about the incident.
PW 3 said when she returned home, she met the neighbours who were around have apprehended the first accused while the complainant was profusely bleeding.
The witness added that Mr Monseray reported the matter to the Adonkia Police Station and that a team of police from the aforesaid police station visited the crime scene and took photographs.
She rounded up her evidence that she made a statement to the Lumley Police Division in Freetown.
The first and second accused were not legally represented, they conducted cross examinations on their behalf.
Similarly, Defence Counsel A. K. Williams representing the third accused cross examined the witness on behalf of his client.
The accused were denied bail and remanded in prison on Pademba Road in Freetown.
Meanwhile, the matter was adjourned to 20th October 2022.
