Mohamed Sesay has been sentenced to 10years imprisonment by Justice John Bosco-Alieu of the High Court No.1 in Freetown on one count charge of Sexual Penetration.
It was alleged in the particulars offence that the accused person Mohamed Sesay on the 23rd April 2017 at Freetown in the Western Area of the Republic of Sierra Leone engaged in an Act of sexual penetration with a child.
The judge Justice John Bosco Alieu in his summoning up address to the court said the Prosecution called six witnesses to support its case against the accused person and the accused person is sentenced on the old Act of the sexual penetration Act.
He said first Prosecution Witness Alice Margay detective Sergeant 9928 attached at the Family Support Unit (FSU) said she recognizes the accused person and the victim in the matter.
In her testimony, she said on the 25th April 2017 she was on duty at the FSU harbor police station Freetown when a case of Sexual Penetration against the accused was brought to the station.
She continued during her testimony that she obtained statements from the victim and other relevant witnesses and issued a medical request form to the parents of the victim for her to be examined and treated at the Rainbow Center before obtaining Voluntary Caution Statement (VCS) from the accused.
She further stated that the accused was charged on the 17th May 2017 with the offence of Sexual Penetration of a child.
She also said they visited the crime scene along with the victim and her parents to a storey house fenced with a gate wherein there are other buildings facing the house of the victim and that there are four rooms in the house with two rooms facing the other two rooms she said as the accused room was inspected and that the victim identified where the accused was when he inserted his fingers into her vagina.
The judge said he is convinced that the Prosecution has proved its case without any iota of doubt and hereby found the accuse person guilty of the offence and sentenced him to 10years.
Defense lawyer for the accused C.Tucker Esq made plea mitigation on behalf of the accused.
However, the accused was sentenced to 10years and the number of years the accused had spent to be deducted from the said term of the Imprisonment.
The accused was represented by C.Tucker Esq from legal Aid board and the state prosecutor was A. Jalloh Esq.
