As Preliminary Investigation continue on the murder matter between the state and Lance Corporal 181808871 Gbassay Kargbo and Amadu Bilor Jalloh, the fourth prosecution witness, Abu Kargbo has told the court that after he saw what happen he decided to keep quite in order to save his life.

The two accused on the above account are before the court for murdering Ahmed Boie Kamara.

It was alleged that on Wednesday 9th March 2022, at Madonkeh village, Newton the accused persons conspired together with other persons unknown to murder Ahmed Boie Kamara .

Leading evidence by Assistant Superintendent of police Christiana Davies Cole ESQ Prosecution witness number five detective inspector Mathew Jibao Karim Vangahun, attached to the homicide syndicate office at the Criminal Investigation Department Headquarters said he recognize the accused and also know the complainant in the matter.

PW5 said he recalled the 10th day of March 2022 whilst on duty at the Homicide office CID headquarters, one Ahmed Kamara of No.8 Metzger lane, Mount Areole Freetown accompanied by Bai Kamara and Zaihurahim Oluwale Tejan Sie arrived in the office and made a report that his brother Ahmed Boie Kamara was Assaulted by a group of people including both accused persons, and as a result of that Ahmed Boie kamara died. The accused further informed the police witness that the deceased is at Connaught Mortuary, and the witness he obtained statements from complainants and witnesses.

Pw 5 continued that on the 11th day of March 2022, a postmortem request was made available to him and sent back to Dr Owizz Kamara for postmortem examination on the remains of Osman Boie Kamara.

On the 12th day of March 2022, a team of police detectives including myself and the scene of crime officer left CID headquarters for Madinkeh village, Newton Town, witness narrated.

He added that on our arrival at Newton junction they met the complainant waiting for them, and on boarded the vehicle. Few yards away with the vehicle, the complainant identified to us by the road where he said he met the deceased. He also identified another route where he saw the second the accused and other people. The witness said he obtained statements from other witnesses at Madonkeh village.

On the 16th March 2022, he and DPC 13274 Hasan B. witnessed the postmortem examination at Connaught Mortuary.  At the conclusion of the postmortem examination the witness said he was issued a copy of certificate of death. The said certificate of cause of death has been in the custody for the police, produced and tendered as exhibit A.

On the 20th day of March 2022, the accused persons arrived at the Homicide office to make statements, the witness and Detective inspector Kasdigbama obtained contemporaneous interview statement from the accused persons.  The said statements have been in the custody of the police produced and tendered as exhibit B1 to 28. The same was done to the second accused which he admitted to be true and correct by affixing his right hand thumbprint on it. Witnessed by myself and Detective inspector Paul Mackie signed it as the recorder.  The said statement has been in custody of the police produced and tendered as exhibit c1 to 17. On the 31st day of March 2021, myself together with Detective inspector kassigbama left for Newton police post to confirm whether there was a report of Assault against the deceased. We confirmed that there was report of Assault; we copied the portion of the entries in the diary. A copy was made in respect of threatening by one Bai Kamara of Newton junction.  The said copy of the report has been in custody of the police produced and tendered by consent as D1 to 2.

On the 14th day of April 2022, both accused persons were charged separately for the offences of Conspiracy to commit a felony and murder. Detective inspector Mackieu cautioned and questioned the accused persons separately in krio language. They made statement in krio separately which were recorded down by me in English language separately.  At the conclusion of their recorded charge statement I read it over and explained to the accused persons in krio language separately which they admitted it to be true and correct by affixing their right hand thumbprint on it separately witnessed by DPC Paul Mackie and I signed as the recorder separately. The charge statement of both accused persons have been in the custody of the police produced and tendered as exhibit E1 to 3 for the first accused and exhibit F1 to 4 for the second accused.

Magistrate Sahr Kekura sent both accused to the male correctional center in Freetown, and matter adjourned to the 3rd June 2022.
