28yrs old Abdulai Sesay made his first appearance before Magistrate Sahr Kekura of Pademba road court No.1 in Freetown on one count charge to wit sale of unsound food to the public contrary to section 109 (1) (a) of the Public health and sanitation Act 1960
According to the particulars of offence the accused person at Saint John the western area in Freetown was found selling a combined mixture of red colorings and bitter Cola product of Kadco Sierra Leone Limited for the purpose of sale to the public.
Led in evidence by Corporal 12090 Zainab Y Bangura prosecuting witness number one police constable 20407 Aminata Fillie attached at KADCO office.
The witness said she recognized the accused person in this matter.
She recalled on the 9th February 2022 around 10am the Manager called her and he went along St John they met people gathered together and one man told the Manager that I called you on phone and you’re the one making this product.
Then the man took one of the bottle that has the KADCO label and the Manager looked at it and told the man that this is not our product, then the said man that called on phone told the Manager that I used to drink this product and I have frequent stomach and the said man took them to the accused person that use to sold the product to them.
The witness said she took the accused person and the evidence to Adelaide Street police station where she handed over him to the police station.
The accused person told her that his aunty uses to give him the product for sale.
They went to the said aunty she was not around and she took the accused person back to Adelaide Street police station and they later transferred them to CID headquarters Pademba Road Freetown.
She handed over the accused person and the exhibit to the police officer at the Criminal Investigation Department headquarters Pademba Road Freetown, she made statement at the said police station.
During cross examination by the defense of the accused person what you just said to this court is it true the witness said yes.
However Magistrate Keikura adjourned the matter to the 12th April 2022 for further hearing.
