Kono alleged murder witness cross examined

Mohamed Johnson, Aiah Komba, Kalilu Fofanah, Victor Kellie and Ishmael Charles made another appearance before Magistrate Sahr Kekura of Pademba road court No.1 in Freetown on two count charges to wit Conspiracy to commit murder contrary to law and Murder contrary to law

According to the particulars of offence on Tuesday the 20th April 2021 at Koidu Town in the Gbesseh Chiefdom in the Kono Judicial District the Eastern Region of the Republic of Sierra conspired together and with other persons unknown to commit a felony to wit Murder and on the same date at the same place unlawfully murdered Kai Osman Fengai.

Prosecution witness number five Komba Sandy was cross examined by Jessie M Jengo the Lawyer representing all the accused persons putting his question to the witness he said on the day of the alleged incident before they arrived at the house of the second accused person and according to the witness on his testimony he said it was around 9:00am and at that very day the witness was in the house of the second accused person.

 The witness responds and said yes and asked where he came from on that day before he arrived at the house of the second accused person the witness said from a Barbing shop

Ask him the name of the deceased and the witness said Kai Osman Fengai and what was the nick name of the deceased witness said he didn’t know.

He put the question that when he was in the car with the Deceased they passed in front of the house of the second accused person.

 The witness said yes and on that day Tamba Senesie didn’t go at the house of the second accused person and the Mother of Kai Osman Fengai told them not to take his Son anywhere to fight.

 There comes an objection from state Counsel and before the incident occurred Tamba Senesie drove off and he was not at the scene and the witness said they are four in numbers in the car Kai Osman Fengai, Tamba Senesie, Sahr J Boima.

The defence counsel put a question to the witness that his friend Mohamed Jalloh was with them in the car, the witness said not to his knowledge and most of the things that happened in the incident he don’t know about it the witness said he knew some of it.

However, Yusif Isaac Sesay said during cross examination the defence applied for the statement of the witness on the last adjourning date.

Responding to the state Jessie M Jengo said the state has to wait for his no case submission

The state counsel referring the magistrate to Section 190 sub section (1) (3) and it was read by the state in court here comes the consultation between the State and the Bench and magistrate Keikura told him that it’s left with the Bench to determine that when given his ruling.

However Magistrate Keikura adjourned the matter to the 26th November 2021 for further hearing.
