Obi Momoh Katta, a self -styled gangster has been fined by magistrate Sahr Kekura of Pademba Road Court No.1 to pay the sum of three million leones or serve two years Imprisonment after he was found guilty on two counts of Assault Occasioning actual bodily harm and impersonation
Delivering his ruling on the above matter, magistrate Sahr Kekura said the accused was arraigned before him for assault Occasioning actual bodily harm contrary to section 47 of the persons Act 1861 and impersonation contrary to section 3 of cap 34 as amended by section 3 of the impersonation and Uniform Amendment Act No. 13 of 1975.
He said the charges were read and explained to the accused and he pleaded not guilty.
Magistrate Sahr Kekura further stated that the brief fact before him was that the accused Obi Momoh Katta on Friday 28th May 2021, at Fofoo Water, waterloo in the waterloo rural district assaulted complainant Mohamed Osman Mahoi in a manner thereby Occasioning actual bodily harm and with intent to defraud falsely pretended to be a member of the Sierra Leone police force and under such color assumed charge complainant the sum of ten thousand leones ( 10, 000,00) in Sierra Leone currency.
He said in proving its case, the prosecution called three witnesses including the formal witness and the exhibit clerk respectively.
Magistrate Sahr Kekura in continuation of his ruling said the accused cross examined all prosecution witnesses for and on behalf of himself.
He said at the close of the prosecution’s case, the accused in defending himself select to rely on his statement made to the police.
Looking at the evidence adduced before the court including the confessional statement of the accused in which he stated that the allegations against him are true and correct, magistrate Sahr Kekura said he is convinced that the prosecution has proved their case beyond all reasonable doubt on both count charges against the accused.
He therefore fined him to pay the sum of three million Leones or serve two years Imprisonment.
