One Discharge for Lack of Evidence

The accused person appeared before Hon. Justice Alhaji Momoh-Jah Stevens in the Modern Sexual Penetration Court in Freetown on the 11th October, 2021. The alleged accused person is before the court on one count charge of sexual penetration.

“This accused person has been behind bars for 5 years and the matter has not been progressing since 2017” said the judge. The judge continued to say that he wants to discharge him.

He advised Legal Aid Board Director to relocate the alleged accused person to another community as there was no evidence before the court against the alleged accused person though there was preliminary investigation conducted at Magistrate but the accused person been there for a very long time.

The accused person on a date between the 1st August and the 31st August, 2017 at Freetown in the Western Area in the Republic of Sierra Leone allegedly engages in an act of sexual penetration of a child.

The court registrar put the charge to the accused person he pleaded guilty of the offense of sexual penetration.

When the judge was addressing the accused person he said the accused person has been in custody for long time since 2017 to 2021. “Since his arrest since 2017 he has spent 4 years in custody and he has served the years of the sentence “said the judge.

The judge ordered Legal Aid Board Director to relocate the accused person back to his village as he has served his sentence to time.  I.A. Kamara is representing the State while C. Taylor Young is representing the alleged accused person.
