In Murder Matter: State Counsel Closes Case

 Accused person, Kaprie Kaborro appeared before Justice John Bosco Allieu on the 9th September, 2021 at the High Court in Freetown to answer to five counts of indictment ranging from conspiracy to murder, conspiracy to course grievous bodily harm, wounding with intent to curse gravois bodily harm, causing grievous bodily harm, riotous conduct in actual bodily harm with intent to his people by carrying offensive weapon without lawful authority.

 State Counsel, J.M.S. Bull Esq has closed her case of murder, wounding with intent to curse gravois bodily harm case between the State and the accused person Kaprie Kaborro who is standing before the court on five counts charges. The State Counsel has closed her case by tendering the committal certificate of warrant that was given by the Magistrate at Pademba Road Court.

Testifying in court, Police Witness Detective Police Constable 9268 Collins J.J. attached to the Major Incident Unit at the Criminal Investigation Departments Headquarters Pademba Road said that he recognized complainant and the accused person. Collins said he recalled on the 25th June, 2020 as he was on duty at the Major Incident Unit and his department received a transferred case and inquiry file touching on the case of wounding with intent from the Makeni Division.

Witness said himself together with Inspector Alimamy Kamara and other personnel were assigned to proceed with investigation, and that the case and inquiry file was forwarded and registered for the purpose of continuing the investigation. Witness disclosed that the file contains certain documents that is to say statement of complainant, witnesses and voluntarily cautioned statement from the accused person inclusive photograph of the complainant.

Detective Collins said on the 9th July, 2020  said he obtained charged statement from the accused person together with Detective Police Constable 12057 Koroma B. contemporaneously interview the accused person in the process he was cautioned and question in Krio and the accused person made statement in krio which he recorded in English and at the conclusion he read it over in English and explained to the accused person in Krio which he admitted to be true and correct by affixing his right hand thump finger print. Witness said the process was witness by DPC 12057 Koroma B. and he signed as the recorder.

There was no cross examination by defense counsel. When State Counsel, Lawyer JMS Bull was giving her closing statement she said that this matter started as preliminary investigation at the Magistrate Court and the accused person was charged with various offenses and at the conclusion of the preliminary investigation the accused person was committed to the High Court. She tendered the certificate of committal to the court. The State continued to say that this is the case of the prosecution and she read the certificate of committal to the High Court.

However, J.M.S. Bull representing the states while Lawyer Cecelia Tucker represent the accused person.
