25YEARS OLD REMANDED FOR SEXUAL PENETRATION

A Driver by the name of Allen Cole ‘alias Kaka Case’ has on the 9th November, 2021 made his first appearance before Justice Manuella Harding at the Modern Sexual offences Court in Freetown on one count charge of sexual penetration contrary to section 19 of the sexual offences Act, 2012, Act no. 12 of 2012 as repealed and replaced by section 4 (a) (ii) of the sexual offences Amendment Act 2019, Act no. 8 of 2019.

First prosecution witness (PW1) testified before Justice Manuella Harding at the Modern Sexual Offences Court in Freetown about how the accused person Allen Cole alias Kaka Case sexually penetrated her.

The Victim said that she was sent by her mother to collect empty palm wine rubber bottles from the accused.

 The victim said the accused got hold of her mouth preventing her from shouting and later the accused took off the victim’s trousers and pants and grabbed her and sexually penetrated her.

The victim said her mother noticed her walking with legs apart on two occasions of which the victim mentioned the accused to be the one who sexually tampered with her. The victim furthered that Allen Cole has sexually tampered with her on four occasions.

Second Prosecution Witness (PW2), Mamie Fofie said the accused was a family man living in the same area with her. She said that between April she observed that the victim was walking with legs apart, she said she called the victim and asked who did it to her and the victim said it was the accused.

She continued that she went to the accused house to confront him but unfortunately the accused was not at home.

The victim’s mother said again in May 2021, she and the victim with other children went to fetch water and upon returning home, she noticed that the victim was walking Abnormal as if she was sick and asked her persistently and the victim mentioned the accused again.

The victim’s mother said she became angry and took the victim to the chairlady Madam Adama and explained to her and in turn advised her to take the victim to a nurse for checkup and subsequently the nurse confirmed that the victim has been sexually tampered with.

 She said the chair lady then sent for the accused to confirm the allegations levied on him but the accused denied.

The victim’s mother concluded that lately the accused said that he was not the only one sexually tampering with the victim and made mentioned of another accused by the name of Ibrahim police.

 She said the accused explained that Ibrahim police usually carries the victim on his lap at his veranda but when the victim was asked she denied having affair with Ibrahim police.

Third prosecution witness (PW3) Adama Harding a petty trader and chair lady Juba zone said he knew the accused as a community person, she recalled that in the evening hours, she was at her house when the victim’s mother met her at home and asked for the accused wife’s kadie to be called up on and the said chairlady also invited her husband’s little sister Jebeh to be a part of a meeting.

She said the victim’s mother narrated the story and she asked the victim and the victim said the accused sexually tampered with her.

Mrs. Adama Harding continued that the victim and her mother and a nurse named Jane confirmed that the victim has been sexually tampered with.

 She said she immediately sent for the accused, and the accused denied the allegations and she and the accused, the victim, victim’s mother and the victim’s father went to the police station and the police referred them to the Rainbo center.

The accused was represented by JM Jengo Esq. While the state was represented by O.V Robbin Mason Jnr.

The matter has been adjourned to the 13th November 2021.
