One Mohamed Jumu has dragged two business tycoons Abdul Malik Kabba and Abdul Jalloh to court for failing to comply with an agreement made after they hit his vehicle.
Led in evidence by prosecuting counsel, Alie Sesay the witness recognized the defendants in the dock in respect of the matter.
He said between January and February this year, he was driving from Waterloo to New York and a vehicle approached him with full speed and he decided to park waiting for them to drive through.
Complainant said the accused left their lane driving towards his and hit his vehicle.
He said he alighted from his vehicle and went to the one that hit him and met Abdul Malik Kabba, Abdulai Jalloh, the driver and a lady to whom he narrated the damage they have done to his vehicle.
Complainant said the first defendant advised him to not worry as he is the owner of the vehicle that hit his and that he will take him ( complainant and his driver) for first aid treatment but to no avail.
Explaining further complainant said they waited for over two hours but first defendant did not show up, an action which led him to make a report at Tokeh police post.
He said later they met at Adonkia police post, the first defendant made an agreement to fix his vehicle.
prosecuting counsel was about to show his client the agreement paper for perusal when defence counsel Omo Lisk objected on the grounds that defense counsel promised to give the photocopy of the said documents.
Responding to that, magistrate Sahr Kekura said prosecuting counsel should have laid a foundation before trying to show his client.
In that light, magistrate Kekura advised prosecuting counsel to take a date in order for him to do the needful.
He also advised counsel for the defendant to do the right thing after informing the court that a variation must be done.
After batting side to side, prosecuting counsel and counsel for the defendant agreed to come back at court on the 15th of November 2023.
